隱私權政策 (Privacy Policy)

學習者科技有限公司(Learner Technology Limited,註冊於香港特別行政區,以下簡稱「本公司」、「我們」)尊重並依法保護用戶(以下簡稱「您」)之個人資料。本隱私政策(「本政策」)說明本公司透過「Learner」應用程式(「本程式」)收集、使用、儲存、分享及處理您資料之方式。本政策依據香港《個人資料(私隱)條例》(第 486 章,「PCPDO」)原則制訂,並適用於本程式之全體用戶。當您下載、註冊或使用本程式時,即表示您已閱讀、理解並無條件同意本政策。若您不同意本政策之任何部分,請立即停止使用本程式。

Learner Technology Limited (registered in the Hong Kong Special Administrative Region, hereinafter the "Company", "we", or "us") respects and protects user ("you") personal data in accordance with applicable law. This Privacy Policy ("Policy") describes how we collect, use, store, share, and process your data through the "Learner" application (the "App"). This Policy is formulated in accordance with the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486, "PCPDO") and applies to all users of the App. By downloading, registering, or using the App, you have read, understood, and unconditionally agree to this Policy. If you do not agree with any part of this Policy, please immediately stop using the App.

1. 我們收集的資料 (Data We Collect)

為提供、維持、改進本程式服務及實現相關商業目的,我們可能透過直接、自動、第三方服務商或其他合法途徑,收集以下類別之資料:

  • 帳號與基本資料:電子郵件、用戶名稱、密碼(加密儲存)、年級、所選角色(學生/導師)、語言偏好、頭像。
  • 身分認證資料(您主動提供):學生證、成績單、履歷(CV)、其他驗證文件。
  • 學習與互動資料:做題紀錄、錯題本、學習進度、火花值、收藏題目、通關紀錄、使用時長、貼文、留言、舉報及封鎖紀錄。
  • 聊天與訊息:您與 AI 導師、人工導師或其他用戶之對話內容(包括文字、圖片、語音)。
  • AI 輸入與輸出資料:您提交予 AI 之提示詞(Prompts)、上傳之題目影像/文字、AI 生成之回應、學習報告及出題結果。
  • 付款與訂閱資料:透過 Apple App Store 處理之訂閱層級、訂閱狀態、續訂日期、優惠券使用紀錄(本公司不接觸您之信用卡或銀行資料)。
  • 裝置與技術資料:裝置型號、作業系統版本、應用程式版本、語言、時區、IP 位址(用於風險偵測)、廣告識別碼(如適用)、Crashlytics 崩潰紀錄、效能診斷資料。
  • 使用行為與分析資料:透過 Firebase Analytics、自訂事件等收集之畫面瀏覽、按鈕點擊、功能使用頻次、付費漏斗轉換、留存率等統計資料。
  • 位置資料(粗略):本程式不主動取得 GPS,但可能透過 IP 推算大致國家/城市(用於本地化、風險偵測及合規)。

To provide, maintain, and improve the App and for related business purposes, we may collect the following categories of data through direct, automated, third-party, or other lawful means: account & basic info (email, username, encrypted password, grade, role, language preference, avatar); identity verification documents (voluntarily submitted); learning & interaction data (practice records, mistakes, progress, sparks, favorited questions, levels cleared, time spent, posts, comments, reports/blocks); chat & messages with AI tutors, human tutors, or other users (text, images, voice); AI inputs/outputs (prompts, uploaded question images/text, AI responses, reports, generated questions); payment & subscription info via Apple App Store (subscription tier, status, renewal dates, coupon usage; we do not access your credit card or banking data); device & technical data (model, OS version, app version, language, timezone, IP address for risk detection, advertising ID where applicable, Crashlytics crash reports, performance diagnostics); behavioral & analytics data via Firebase Analytics and custom events (screen views, button clicks, feature usage, paywall funnel, retention); coarse location (we do not actively collect GPS; we may infer country/city from IP for localization, risk detection, and compliance).

2. 我們如何使用資料 (How We Use Data)

本公司可能將上述資料用於以下用途,包括但不限於:

  • 核心服務:提供本程式五大功能(練習、統計、挑戰、導師、個人);驅動 AI 出題、AI 批改、AI 學習報告、AI 對話。
  • 身分審核:您所提交之認證文件僅用於身分及導師資格審核,審核完成後安全儲存。
  • 安全與防濫用:偵測並防範未授權登入、自動化攻擊、欺詐、刷量、刷課、學術舞弊、違規內容傳播。
  • 服務改進與研發:透過彙整、匿名化或去識別化處理後之資料進行統計分析、產品迭代、AI 模型微調及效能優化。
  • 個人化體驗:根據您之做題紀錄、難度等級及偏好調整內容推薦及學習路徑。
  • 運營與商業分析:用戶留存、活躍度、轉換漏斗、訂閱轉換率、地域分佈等統計分析。
  • 客戶支援:處理您透過 App 內回饋通道提交之請求、申訴或投訴。
  • 溝通:於應用程式內或透過電郵發送服務通知、版本更新、政策變更通知、安全警示及(您同意之情況下)行銷推廣。
  • 法律合規:履行依法須執行之義務、回應執法機關之合法要求、保護本公司及他人之權利。

匿名化/彙整資料之使用:本公司可將您之資料以匿名化或彙整方式(無法識別個人身分)使用於上述用途及任何其他合法業務目的,且不受本政策關於個人資料之限制。

We may use your data for purposes including but not limited to: core service delivery (powering the five modules — Practice, Statistics, Arena, Tutor, Profile — and AI features); identity verification (used solely for verifying student/tutor status); security and abuse prevention; service improvement and R&D (using aggregated, anonymized, or de-identified data for statistical analysis, product iteration, AI model fine-tuning, and performance optimization); personalization; business analytics; customer support; communications (in-app or via email for service notifications, updates, policy changes, security alerts, and — with your consent — marketing); legal compliance. Anonymized/Aggregated Data: We may use your data in anonymized or aggregated form (which cannot identify any individual) for the above purposes and any other lawful business purposes, and such use is not subject to the restrictions of this Policy regarding personal data.

3. 資料分享與第三方服務商 (Data Sharing & Third-Party Service Providers)

未經您之明確同意,本公司不會將您之個人可識別資訊出售予任何第三方。然而,為提供及優化服務,您之資料可能於以下情境中被分享:

  • 用戶主動授權之分享:您主動將您之做題統計、學習報告分享予好友、導師或對戰/社群之情況。
  • 第三方服務商:本公司與以下供應商合作,該等供應商可能位於香港境外(包括美國、新加坡、亞太區其他地區)並依其本身之私隱政策處理資料:
    • Google/Firebase(雲端資料庫、Authentication、Cloud Functions、Analytics、Crashlytics、Cloud Storage)
    • Apple Inc.(App Store 訂閱、推送通知、Sign in with Apple)
    • RevenueCat(訂閱管理)
    • AI 模型供應商(包括但不限於 Google Gemini、DeepSeek 及其後續或替代供應商)
    • 其他必要之雲端基礎設施、CDN、客服或反濫用服務供應商
  • 業務轉移:若本公司涉及合併、收購、重組、資產出售、破產或類似交易,您之資料可作為交易資產之一部分轉移予繼任方。
  • 關聯方:本公司之關聯公司、子公司或母公司,於本政策所述目的範圍內。
  • 法律要求:本公司有理由相信須予以披露以遵守法律、法院命令、執法要求;保護本公司、用戶或公眾之權利、財產或安全;防止或調查可能之違法行為。

We do not sell your personally identifiable information to any third party without your explicit consent. Data may be shared in the following contexts: user-authorized sharing; third-party service providers (which may be located outside Hong Kong, including the United States, Singapore, and other Asia-Pacific regions, and process data in accordance with their own privacy policies), including Google/Firebase, Apple Inc., RevenueCat, AI model providers (including but not limited to Google Gemini, DeepSeek, and their successors or replacements), and other necessary cloud, CDN, customer service, or anti-abuse providers; business transfers (in the event of merger, acquisition, restructuring, asset sale, bankruptcy, or similar transactions, your data may be transferred to the successor as a transactional asset); affiliates; legal requirements (where the Company has reason to believe disclosure is necessary to comply with law, court orders, or enforcement requests; to protect the rights, property, or safety of the Company, users, or the public; or to prevent or investigate possible misconduct).

4. 國際資料轉移 (International Data Transfer)

為確保服務之全球可用性、AI 功能之運作及穩定性,您之資料(包括但不限於聊天內容、AI 提示詞、做題紀錄、技術日誌)可能被傳輸、儲存及處理於香港以外之國家或地區,包括但不限於美國、歐洲、新加坡、日本、台灣等。該等地區之資料保護法律可能與香港不同。藉由使用本程式,您明確同意此類跨境資料轉移,並同意我們依本政策及第三方供應商之政策處理該等資料。

To ensure the global availability, functionality, and stability of our services (especially AI features), your data (including but not limited to chat content, AI prompts, practice records, and technical logs) may be transferred to, stored, and processed in countries or regions outside Hong Kong, including but not limited to the United States, Europe, Singapore, Japan, and Taiwan. Data protection laws in these regions may differ from those of Hong Kong. By using the App, you expressly consent to such cross-border data transfers and agree that we will process such data in accordance with this Policy and the policies of our third-party providers.

5. Cookies 與類似技術 (Cookies & Similar Technologies)

本程式及其相關網域可能使用 cookies、本地儲存(local storage)、應用內識別碼及其他追蹤技術,以維持登入狀態、記憶您之偏好設定、提供 Analytics 數據及防範濫用。您可透過裝置設定限制或刪除部分追蹤資料;惟此可能影響本程式部分功能之正常運作。

The App and related domains may use cookies, local storage, in-app identifiers, and other tracking technologies to maintain login state, remember your preferences, provide analytics, and prevent abuse. You may limit or delete some tracking data through your device settings, but doing so may affect the functionality of certain features.

6. 資料安全 (Data Security)

本公司採用業界合理之技術與管理措施保護您之資料,包括傳輸加密(HTTPS/TLS)、敏感資料加密儲存、Firebase Security Rules 存取控制、定期安全審查及第三方供應商風險評估。

惟您理解並同意:網路傳輸與資料儲存無法做到 100% 絕對安全。儘管本公司採取合理措施,本公司不對任何第三方非法存取、駭客攻擊、惡意程式、用戶端裝置失竊、密碼洩露或其他超出本公司合理控制之事件所致之資料外洩、毀損或丟失承擔責任。您應自行妥善保管帳號密碼及裝置安全。

We employ reasonable industry-standard technical and managerial measures to protect your data, including transmission encryption (HTTPS/TLS), encryption of sensitive data at rest, Firebase Security Rules access control, periodic security reviews, and third-party provider risk assessments. However, you acknowledge and agree that no method of network transmission or data storage is 100% secure. Despite our reasonable measures, the Company is not liable for any data breach, damage, or loss caused by unauthorized third-party access, hacking, malware, theft of user devices, password leaks, or other events beyond the Company's reasonable control. You are responsible for safeguarding your account password and device security.

7. 資料保留 (Data Retention)

本公司將於合理且必要之期間內保留您之個人資料,期間長短取決於資料之性質、收集目的、適用法律規範、訂閱關係及實務考量。具體保留期限不對外公告,本公司有權依業務需要、合規要求及技術可行性自行決定保留與刪除策略。

即使您刪除帳號,本公司仍可能保留某些資料於:(a) 完成尚未結束之交易;(b) 履行法律義務或回應監管/執法要求;(c) 防止欺詐、濫用或維護安全;(d) 解決爭議;(e) 已匿名化或彙整之資料(不再構成個人資料)。

We retain your personal data for a reasonable and necessary period determined by the nature of the data, purpose of collection, applicable law, subscription relationship, and operational considerations. Specific retention periods are not publicly disclosed; the Company reserves the right to determine retention and deletion strategies based on business needs, compliance requirements, and technical feasibility. Even after you delete your account, we may retain certain data to: (a) complete unfinished transactions; (b) fulfill legal obligations or respond to regulatory/enforcement requests; (c) prevent fraud, abuse, or maintain security; (d) resolve disputes; (e) retain anonymized or aggregated data (which is no longer personal data).

8. 未成年人隱私 (Minor Privacy)

本程式僅供 13 歲或以上之用戶使用。若您未滿 18 歲,您須在家長或法定監護人之監督及同意下使用本程式。若本公司知悉或合理相信用戶為未滿 13 歲之兒童,本公司有絕對權利立即終止其帳號並刪除相關資料,無須通知。家長若發現子女未經同意使用本程式,可透過 App 內回饋通道請求刪除帳號及資料。

The App is intended for users aged 13 or above. If you are under 18, you must use the App under the supervision and consent of a parent or legal guardian. If the Company learns or reasonably believes that a user is a child under 13, the Company reserves the absolute right to immediately terminate the account and delete related data without notice. Parents who discover their child is using the App without consent may request account and data deletion via the in-app feedback channel.

9. 您的權利 (Your Rights)

在 PCPDO 及適用法律允許之範圍內,您可能享有:(a) 查閱您之個人資料;(b) 更正不準確之資料;(c) 撤回您先前對特定資料處理之同意;(d) 刪除您之帳號(將永久移除您可識別之個人資料);(e) 對處理活動提出異議。

行使方式:您可隨時在 App 內「個人 → 設定 → 帳號與安全」直接刪除帳號,或透過「個人 → 設定 → 給我們的意見」回饋通道提交其他資料權利請求。本公司於確認請求合法且您身分屬實後,將於合理時間內依法處理。本公司可能要求您提供額外資料以驗證請求人身分;對顯失合理、重複或屬濫用性質之請求,本公司有權拒絕或收取合理行政費用。

To the extent permitted by PCPDO and applicable law, you may have the following rights: (a) access to your personal data; (b) correction of inaccurate data; (c) withdrawal of previously granted consent for specific processing; (d) deletion of your account (permanently removing your identifiable personal data); (e) objection to certain processing activities. How to exercise: You may delete your account at any time in "Profile → Settings → Account & Security", or submit other data rights requests via the "Profile → Settings → Feedback" channel. After verifying the legitimacy of the request and your identity, we will process valid requests in accordance with applicable law within a reasonable time. We may require additional information to verify your identity. We reserve the right to refuse, or charge a reasonable administrative fee for, requests that are manifestly unreasonable, repetitive, or abusive.

10. 第三方連結與服務 (Third-Party Links & Services)

本程式可能含有指向第三方網站、服務或應用之連結(包括但不限於 Apple App Store、Google 服務及社交分享平台)。該等第三方擁有獨立之私隱政策,本公司對其資料處理行為不承擔任何責任。您於離開本程式或使用第三方服務前,應自行閱讀該第三方之私隱政策。

The App may contain links to third-party websites, services, or applications (including but not limited to Apple App Store, Google services, and social sharing platforms). Such third parties have their own privacy policies, and the Company assumes no responsibility for their data processing practices. You should review the privacy policy of any third party before leaving the App or using their service.

11. 政策變更 (Changes to this Policy)

本公司有絕對權利隨時修訂本政策。修訂版本將於本應用程式內或官方網站發布後生效,無須個別通知。重大變更(涉及您之法定權利者)本公司可能透過 App 內公告或電郵提供合理通知,惟此並非強制義務。您於修訂發布後繼續使用本程式,即視為您接受修訂後之政策。

The Company reserves the absolute right to amend this Policy at any time. Amendments take effect upon publication within the App or on the official website, without individual notice. For material changes affecting your statutory rights, the Company may provide reasonable notice via in-app announcement or email, but is not obligated to do so. Your continued use of the App after publication of amendments constitutes acceptance of the amended Policy.

12. 用戶權利請求渠道 (Privacy Request Channel)

如您欲行使本政策所述之任何權利、就資料處理事項作出請求或提出查詢,請使用本應用程式內「個人 → 設定 → 給我們的意見」之回饋通道提交。本公司將於合理時間內處理符合適用法律要求之有效請求。

To exercise any rights under this Policy, make data-related requests, or submit inquiries, please use the "Profile → Settings → Feedback" channel within the App. The Company will process valid requests in accordance with applicable law within a reasonable time.

13. 適用法律與管轄 (Governing Law & Jurisdiction)

本政策受香港特別行政區法律管轄並依其解釋。任何因本政策引起之爭議應提交香港法院之專屬管轄審理。本政策以中文及英文書寫,如二者出現分歧,以中文版本為準。

This Policy shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising from this Policy shall be submitted to the exclusive jurisdiction of the courts of Hong Kong. This Policy is written in Chinese and English; in the event of any inconsistency, the Chinese version shall prevail.
