使用條款 (Terms of Use)

1. 接受條款 (Acceptance of Terms)

歡迎使用 Learner（「本應用程式」）。本應用程式專為香港中學生及數學導師設計，由學習者科技有限公司（Learner Technology Limited，註冊於香港）營運。當您下載、安裝或使用本應用程式時，即表示您已閱讀、理解並完全同意受本使用條款約束。

Welcome to Learner (the "App"), designed for Hong Kong secondary school students and math teachers, operated by Learner Technology Limited (registered in Hong Kong). By downloading, installing, or using the App, you acknowledge that you have read, understood, and fully agree to be bound by these Terms of Use.

2. 服務內容 (Description of Service)

本應用程式提供五大核心板塊：練習、統計、論壇、導師及個人中心。我們亦提供整合的人工智能（AI）服務，包含：AI 出題、AI 生成學習報告及 AI 導師聊天教學功能。

The App provides five core modules: Practice, Statistics, Forum, Tutor, and Profile. We also provide integrated Artificial Intelligence (AI) services, including: AI Question Generation, AI Learning Reports, and AI Tutor Chat features.

3. AI 服務聲明 (AI Services Disclaimer)

本應用程式提供的 AI 導師、AI 出題及 AI 分析報告旨在輔助學習，不保證其內容的絕對準確性或完整性。用戶應將 AI 提供的解答作為參考，我們不對因依賴 AI 內容而導致的任何學業成績後果負責。

The AI Tutor, AI Question Generation, and AI Analytical Reports provided by the App are intended for educational assistance only. We do not guarantee the absolute accuracy or completeness of AI-generated content. Users should treat AI answers as a reference. We are not liable for any academic consequences resulting from reliance on AI content.

4. 用戶行為與內容審查 (User Conduct & Moderation - Zero Tolerance Policy)

本應用程式包含論壇發帖、留言及私人聊天等交互功能。我們對於任何違規內容採取零容忍政策 (Zero Tolerance Policy)。您同意絕對不會發布以下內容：

具攻擊性、暴力、色情、威脅或歧視性質的言論。
侵犯他人知識產權或隱私的內容。
任何違反香港特別行政區法律的內容。

舉報與封禁機制： 用戶可透過 App 內的「舉報 (Report)」及「封鎖 (Block)」功能對不當內容及用戶進行檢舉。一經查實用戶違反公序良俗或上述規定，本公司有絕對權利立即永久封禁該帳號，且不作任何形式之退款或賠償。

The App includes interactive features like forum posts, comments, and private chats. We enforce a Zero Tolerance Policy for objectionable content. You agree that you will never post content that is:

Offensive, violent, pornographic, threatening, or discriminatory.
Infringing on others' intellectual property or privacy.
In violation of the laws of the Hong Kong SAR.

Reporting and Ban Mechanism: Users can flag inappropriate content and block users via in-app "Report" and "Block" features. If a user is found violating public order, morals, or the above rules, the Company reserves the absolute right to permanently ban the account immediately, without any form of refund or compensation.

5. 身分認證與資料分享 (Verification & Data Sharing)

如您申請成為官方認證學生或導師，需提交身分證明（如學生證、成績單、CV）。您保證所提供之資料真實有效。偽造文件將導致永久封禁。此外，您的做題記錄與統計數據，唯有在您主動操作並同意的情況下，才會分享給他人。

If you apply to be a verified student or tutor, you must submit identity documents (e.g., student ID, transcripts, CV). You guarantee that the provided information is authentic. Forging documents will result in a permanent ban. Furthermore, your practice records and statistics will only be shared with others upon your proactive operation and consent.

6. 訂閱與退款政策 (Subscriptions and Refunds)

PRO 會員訂閱服務（包含月費、季費、年費等）透過 Apple App Store 系統處理，受 Apple 的標準終端用戶授權協定 (EULA) 約束。除非適用法律強制要求，否則已支付的訂閱費用一律不予退還。

PRO subscription services (including monthly, quarterly, and annual plans) are processed through the Apple App Store and are subject to Apple's Standard End User License Agreement (EULA). Paid subscription fees are strictly non-refundable unless mandated by applicable law.

7. 適用法律 (Governing Law)

本使用條款受香港特別行政區法律管轄並依其解釋。任何因本條款引起的爭議應受香港法院專屬管轄。

These Terms of Use shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
